Traffic Violation

Traffic violations are offenses that are punishable by a fine, but are not punishable by a term of imprisonment.

Josephine County has established a Violations Bureau under ORS 153.800. Any person who receives a traffic violation may appear before the Violations Bureau. The Violations Bureau authorizes a violations clerk to accept a plea of no contest or not guilty on violations that do not require mandatory court appearance.

What are your options?

  • Mail: If you wish to appear by mail, you will need to complete the back of your copy of the citation and include the entire base fine amount when you mail the citation.

If you enter a plea of no contest, the violations clerk will assess a fine and process your payment.

If you enter a plea of not guilty, your case will be set for a court trial at a later date. You will receive a trial notice in the mail.

If you request a payment schedule instead of mailing in the base fine amount, the court is required to assess a mandatory Account Administration Fee. The amount of the fee is based on the amount of your fine.

  • Phone: you may enter your plea by phone.

If you enter a plea of no contest, the violations clerk will assess a fine and process your payment.

If you enter a plea of not guilty, your case will be set for a court trial at a later date. You will receive a trial notice in the mail.

If you request to pay the fine that day, the clerk ask how you wish to pay for your fine (credit card, debit card or cash).

  • In Person at the Accounting/Traffic Counter: If you appear in person, you may appear any day after the citation has been received by the court and before your appearance date indicated on the bottom of the citation.

Citations are usually received by the court seven (7) to ten (10) days after you are cited

If you enter a plea of no contest, the violations clerk will assess a fine.

What are your plea options?

  • No Contest: When you enter a plea of no contest, you waive your right to a court trial and indicate that you agree to the penalties for your offense.
  • Not Guilty: If your intention is to enter a plea of not guilty, the judge will not hear any evidence at a traffic court appearance. The case will need to be set for a court trial when the officer will be present. The violations clerk will refer the file to calendaring to be set for a court trial. You will receive notice of the trial date in the mail. At the trial you will be able to give any evidence you have and call any witnesses you have.

Extension

To receive an extension on your appearance date, you will need to contact a violations clerk to see if you qualify.

Failure to Appear

If you do not appear on or before your scheduled appearance date, the violations clerk will enter a default judgment. The entire base fine will be assessed and additional mandatory court costs will be added.

Paying Your Fine

Your fine is due and payable on the date the judgment is entered. If you are not able to pay the fine in full, the court can set a monthly payment schedule. If a payment schedule is added, the court is required to add an additional Account Administration Fee. This fee is based on the total fine amount per case.

Failure to Pay Your Fines 

If you do not make your monthly payments on time, the court will notify the Department of Motor Vehicles (DMV) and your drivers license will be suspended. Additionally, the court is required to add a License Suspension Fee. The court may also refer your account to either the Department of Revenue (DOR) or another collection agency for collection. You will then be required to pay the Cost of Collections.

DMV Letter

If you receive a letter from the DMV notifying you that your license is going to be suspended, you will need to talk to the Accounting Department.
