* YOU MUST RECEIVE AUTHORIZATION FROM THE COURT BEFORE YOU ATTEND TRAFFIC SCHOOL *
The Traffic Safety School Diversion Program is offered by the Josephine County Circuit Court. It is available to qualified drivers for the dual purposes of promoting safe driving and allowing the driver to not have a conviction entered on their driving record.
You may be qualified to participate in the diversion program if:
You do not possess a commercial driver's license (CDL).
You have had no other moving violation tickets within the last three years.
You have not participated in any other traffic diversion or traffic school program during the last three years.
You were not cited for being in an accident at the time the ticket was issued.
You were not cited for traveling in a safety corridor, school zone, construction zone or other specially designated zone.
You were not driving over 100 miles per hour.
The conditions of the program are as follows:
You waive the right to trial.
You plead "guilty" or "no contest" to the charge you have been cited for.
You complete and file a diversion agreement.
You pay 75% of the base fine assessed on your citation.
Payment in full must be made within 90 days of the date the agreement is filed with the court.
Additional fees and license suspension may be incurred if full payment is not made within the 90 day period.
You attend and complete the court-approved traffic school program to which you are referred within 120 days of the date the agreement is filed with the court.
Each program charges a program fee.
You must pay the fee directly to the program provider.
You MUST attend one of the court-approved programs (redundant).
You WILL NOT receive credit for attending any other program.
You provide proof to the court of program attendance IF the program you attend does not automatically report to the court.
You call the court two (2) weeks after course attendance to confirm that notification of your program completion has been received.
You obey all traffic laws of this and all other states during the 120 day diversion period.
If the court finds that you are eligible for the diversion program, and if you comply with the conditions of the agreement, the court will dismiss the traffic offense you were charged with. DO NOT enroll in a traffic school program until you have received a signed copy from the court approving you to enroll. You will have 120 days from the date the diversion agreement is filed with the court to complete the program requirements.
If you are interested in the program, a diversion agreement will be provided to you by the court. The agreement must be filed with the court no later than fourteen (14) days after your scheduled court appearance.
NOTE: The court will terminate the diversion agreement if the court finds that you have violated the terms of the diversion agreement or if you fail to complete the requirements within the 120 day diversion period. You will be convicted of the offense and it will go on your driving record.
