Parenting Plan Information

INTRODUCTION:

 

This material will help parents create basic parenting time plans that are age-appropriate for their children.  The Guide was developed by the State Family Law Advisory Committee's Parenting Plan Workgroup, which consulted parents and advocates as well as many professionals, including judges, court staff, attorneys, mediators, evaluators, and parent educators.  The guide has been updated to make it more clear and user-friendly.   Oregon law requires a parenting plan where children are involved.    ORS 107.102

 

If you have safety concerns, this list of questions can help you decide if you need a Safety Focused Parenting Plan

 

IMPORTANT NOTICE: Not all courts accept the parenting plan forms below. If you choose not to have a lawyer and to represent yourself, please check with your local court and/or facilitator to find out whether the court in your county accepts them.

 

PARENT EDUCATION CLASSES:  Many counties in Oregon require parents to complete a parent education class before a judgment can be entered in cases involving custody and parenting time of children. Please contact your local court for more details.  Click on the link for a listing of Oregon parent education classes used in Oregon family law cases as of January 2008.  

We recommend that you review the information provided below before you start filling out the worksheet and completing the form.  The worksheets have links that can help you understand unfamiliar words or give you access to information you may need to complete your forms.

 

You can complete the form by typing in your responses on the computer, rather than hand writing them in, and then saving the completed form on your computer. 

 

You will need to print the form to file with the court.  Make sure you save a copy of the completed form for your records.  You can also print off the blank forms and complete them by hand if you prefer.  You may add additional pages if you need more room for your responses.

Attachment 3.2-c  offers a place for parents to set out a different parenting time schedule for a child    whose needs are different from his or her siblings, or a different schedule for when the children's needs change due to their growing older.

Attachment 9.5 offers a place to add additional paragraphs to the parenting plan.

 

SAMPLE SCHEDULES for each age group, (ages and stages) provides developmental information, then provides guidance for deciding on an age appropriate parenting time schedule.  Offers at least one suggestion (sometimes more) for three different levels of parental involvement.

How do I know if I need a safety-focused parenting plan?

This list can help you decide.

Has the other parent:

  • acted as though violent behavior toward you or your child(ren) is OK in some situations?
  • damaged or destroyed property or pets during an argument?
  • threatened to commit suicide?
  • pushed, slapped, kicked, punched or physically hurt you or your child(ren)?
  • had problems with alcohol or other drugs?
  • needed medication to be safe around others?
  • threatened not to return or not returned your child(ren)?
  • used weapons to threaten or hurt people?
  • threatened to kill you, your child(ren) or anyone else?
  • sexually abused anyone by force, threat of force, or intimidation?
  • been served a protection or no contact order?
  • been arrested for harming or threatening to harm you or anyone else?

If you answered "yes" to any of these questions, please continue to take your safety, and your children's safety, seriously. In addition, you may choose to create a safety focused parenting plan.
