Enforcement of Oregon Custody
Order/Judgment (Order of Assistance)

If an Oregon judge signed a court order granting you custody, and if the order is still current and valid but the other parent is now withholding custody, you may ask the court to give you an Order of Assistance that directs any law enforcement officer who has jurisdiction to assist you in recovering the child(ren). You must provide the court with a certified true copy of the custody order. There is no filing fee for a motion for order of assistance, however, there may be a fee for the law enforcement agency serving the order.


Enforcement of Oregon Parenting
Time Order/Judgment

If a judge signed a court order establishing parenting time, and if the order is currently valid and is being violated by the other parent, a party may request enforcement of this order. Enforcement of parenting time may be filed for enforcement by either the petitioner or the respondent in the original case (dissolution, separation or unmarried parent petition) if you believe the parenting plan or order is being violated by the other parent. The hearing must be held within 45 days of the date the request is filed. A court may not issue an order of assistance for the purpose of enforcing parenting time or visitation rights.

Enforcement of Out-of-State Custody Order/Judgment

(Order of Assistance)

If a judge in another state previously signed a court order granting you custody, and if the order is still current and valid but the other parent is now withholding custody, you may ask the court to give you an Order of Assistance that directs any law enforcement officer who has jurisdiction to assist you in recovering the child(ren). You must provide the court with a certified true copy of the custody order. There is no filing fee for a petition for order of assistance, however, there may be a fee for the law enforcement agency serving the order.

Enforcement of Out-of-State Parenting
Time Order/Judgment

A court may not issue an order of assistance for the purpose of enforcing parenting time or visitation rights. Parenting time granted in an out-of-state parenting time order/judgment may only be enforced in Oregon after the judgment has been registered as a foreign judgment. Once the registration process is complete, the parenting time may be enforced as if it was an Oregon parenting time order.
