Pretrial Services

Our Mission - Coos and Curry pretrial services provide the court with timely investigative pretrial recommendation reports using evidence-based practices and offer unbiased pretrial monitoring services for clients that focus on community safety, increase court appearance rates, and minimize pretrial detention while inspiring public trust and confidence.

​Pretrial is defined as the time between a person being charged with a crime and the disposition of the case.

​Judges have various options pertaining to release for a defendant in accordance with the law.


Release on Recognizance: 
The release of a defendant upon the promise of the defendant to appear in court at all appropriate times. Recognizance releases are subject to the general conditions of release as ordered by the court (ORS135.230(6)).

Conditional Release: 
The release of a defendant on a non-security release which imposes regulations on the activities and associations of the defendant. This release type contains the general conditions of release and additional special conditions designated to ensure the safety of the public and the alleged victim, and the defendant’s court appearance. Conditions imposed include reasonable regulations on activities, movements, associations, and residences of the defendant (ORS 135.260(1)(b)).

Security Release: 
The release of a defendant conditioned on a promise to appear in court at all appropriate times which is secured by a security deposit (ORS 135.230 (12)). The Court shall set a security amount that will reasonably assure the defendant’s appearance and take the deposit, a sum of money equal to ten (10) percent of the security amount (ORS 135.265).

  • ✔ The Court may order the deposit forfeited to the State of Oregon if the defendant violates the conditions of their release.
  • ✔ No money may be refunded until all matters in this case are completed in Court. If this defendant is found guilty, no money can be refunded until the defendant is sentenced.
  • ✔ Any balance remaining will be refunded to the person indicated on the security release agreement as the person posting the money, unless otherwise ordered by the Court.
  • ✔ No money will be refunded from the Coos Circuit Court Accounting Dept. until the Court has issued a signed order releasing the funds.
Pursuant to ORS 135.265, and order of the Court, the following will be DEDUCTED from the money posted prior to any refund:

  • o​ A 15% fee (not less than $5.00) and no more than $750;
  • ​o Any fines/fees imposed on the defendant from any charges which are pending or filed;
  • o Any money the defendant owes the Court on any Oregon Circuit Court case;
  • o Any money which the defendant owes in child support, and/or;
  • o Any money which the person posting the money owes to the Court on any Oregon Circuit Court case or in child support.

​A defendant will be interviewed by pretrial services as part of the intake process. The interview will occur in one of two ways.


In-Custody
While in custody prior to arraignment, a defendant will be interviewed by pretrial services using a universal screening process to collect information. The information collected will be used to determine eligibility for release and for qualification for court appointed counsel. 
Individuals are assessed for release based on the offenses charged and the application of any person-specific overriding circumstances that may indicate a higher risk of failing to appear or reoffending while on pretrial release. 

Out of Custody
After being released from custody prior to arraignment or after being arraigned by the Judge a defendant is required to check-in with pretrial services for an intake interview and for qualification for court appointed counsel.

​Defendants who are charged with a felony, a crime alleged to be domestic violence, or if released on a security release agreement will participate in pretrial monitoring. Frequency of check-ins is determined by crime category as outlined in PJO 22-01 and court order. Defendants will check-in either monthly, bi-weekly, or weekly as ordered. 


A defendant who is participating in the monitoring program, may have pretrial monitoring suspended or terminated if any of the following occur:
  • The appearance date as ordered by the release agreement passes without charges being filed by the District Attorney.
  • A warrant is issued for the defendant on the case(s) they are currently being monitored.
  • The defendant is found unable to aid and assist.
  • The defendant enters a pre-disposition program such as diversion, deferred sentencing, or conditional discharge.
  • A final disposition is entered on the case such as convicted, dismissed, or acquitted, and the case is closed.
Monitoring of a defendant can be restarted after suspension at any time as ordered by the court, upon release from custody after signing a release agreement, or after charges are filed by the DA, unless the case is closed. 

Check-Ins 
  • Pretrial staff will provide each defendant with instructions for setting up CaselinkPro™ for future phone check-in appointments.
  • Defendants will call into the automated phone check-in system as directed. 
    • o Upon check-in, defendants will verify or update their phone number, physical address, and mailing address. 

Text Message Reminders
  • Defendants will receive reminders to check in from CaselinkPro™ to check in. 
  • All defendants will receive Text to Court Reminders​ regarding upcoming hearing dates.
